95% of cases settle before going to trial. Some statistics are as high as 99% . . . so why then, do lawyers spend months (or even years) working with clients to prepare for trial, an outcome that will likely never happen. Why has the legal system capitalized on taking clients through all of the activities and huge expense of litigation if the case is most likely going to settle?
Settlement offers are better earlier on
A study out of Utah following settlement offers found that the offers made earliest on in the process, and even before filing were the most generous. The sooner a case settles, the less expensive the process will be for everyone involved and the more generous the offer.. The pre-trial discovery process alone involves lengthy depositions, including depositions from accident experts. Experts cost money. Some plaintiff's attorneys will agree to pay pre-litigation expenses upfront.
If you receive a verdict in your favor, there’s 20% chance you’ll collect.
Even if you take your case to trial AND you win. There is a 20% chance you will actually collect on that judgment in your favor. What does that mean. If Joe sues Sue for $100. And Joe “wins” in court, the chance Joe will actually receive his $100 is 20%. That’s risky business. Why? Well appeals are real, and trying to collect from someone is difficult if they are insolvent, facing other legal claims, or flat out just won’t turn over the money or assets.
The legal process is risky business
Not only is it risky because even if you win, you may not collect (see above). It’s also risky to your wallet, mental health, and you have no idea how a judge or jury will rule. Outcomes even with the best lawyers, are not a sure win. While the law is intended to be applied fairly, that is often not the case. In general, people who go through the legal system almost always report they were not satisfied with their outcome or the process. There is no “win.” It’s “lose, lose” all around.
